TERMS & CONDITIONS OF MEMBERSHIP

1. General
These Terms & Conditions apply to all members of UrbanX Fitness ("UrbanX Fitness", "we", "us" or "our") and form part of the membership agreement between UrbanX Fitness and the member ("you" or "your").
By becoming a member of UrbanX Fitness, you confirm that you have read, understood and agree to comply with these Terms & Conditions, our gym rules, health and safety requirements and any reasonable instructions issued by UrbanX Fitness staff.
UrbanX Fitness reserves the right to refuse membership or suspend or terminate membership where a member seriously or repeatedly breaches these Terms & Conditions, subject always to applicable law.
2. 24/7 Gym Access
UrbanX Fitness provides 24-hour, 7-day-a-week access to eligible members, subject to the terms of their membership.
Members must use their own membership access credentials, fob, card, app or other authorised access method. Membership access must not be shared, transferred, lent or provided to another person.
Members must not allow unauthorised persons to enter the gym using their access credentials.
UrbanX Fitness may temporarily restrict or suspend access where reasonably necessary for maintenance, cleaning, repairs, emergencies, health and safety, equipment servicing, private events or other operational reasons.
3. Membership
Memberships are personal to the named member and are non-transferable unless otherwise agreed in writing by UrbanX Fitness.
Members must ensure that their membership payments remain up to date. Where payments are overdue, UrbanX Fitness may suspend access until the account is brought up to date.
Members must notify UrbanX Fitness of any change to their personal details, including contact information, payment details or emergency contact information.
Membership fees, minimum terms, notice periods, joining fees, payment schedules and cancellation arrangements will be set out in the membership agreement or membership plan selected by the member. All memberships require 1month cancellation notice.
Nothing in these Terms & Conditions is intended to remove or restrict any statutory rights a consumer may have under applicable UK law.
4. Gym Rules & Member Conduct
All members are expected to treat UrbanX Fitness, its staff, other members and its facilities with respect.
Members must:
Follow all safety instructions, signage and reasonable instructions given by staff.
Use gym equipment only for its intended purpose, follow instructions (located on equipment where possible) provided by manufacturer.
Return weights and equipment to their designated storage areas after use.
Keep walkways, exits and access areas clear.
Use appropriate footwear and suitable exercise clothing.
Report damaged, faulty or unsafe equipment to UrbanX Fitness immediately to info@urbanxfintess.co.uk.
Equipment that has been 'red tagged' must not be used.
Red tags should not be removed from any equipment unless by a member of staff.
Maintain appropriate standards of personal hygiene and cleanliness.
Behave respectfully towards other members and staff.
Minors:
All minors on the premises must be under the constant supervision and are the complete liability of the parent/guardian.
Children under the age of 16 years is not permitted to access the premises without an adult member.
Children under the age of 16 years are not permitted to use any of the weighted machines.
The following are prohibited:
Fighting, threatening, abusive or aggressive behavior.
Harassment, intimidation or discrimination.
Deliberate damage to gym property.
Theft or unauthorised removal of property.
Tampering with safety equipment, access systems, CCTV or other security equipment.
Smoking or vaping inside the premises.
Consumption of alcohol or illegal substances on the premises.
Any activity that creates an unreasonable risk to another person.
UrbanX Fitness may take appropriate action, including suspension or termination of membership, in response to serious misconduct, subject to applicable law and the terms of the member's agreement.
5. Health, Fitness & Personal Responsibility
Members use the gym and its facilities at their own risk and must exercise within the limits of their own fitness, experience and physical ability.
Members should seek appropriate medical advice before commencing exercise where they have a medical condition, injury, health concern or other reason to believe that exercise may not be suitable for them.
Members are responsible for using equipment correctly and safely and should request assistance or instruction where they are unfamiliar with a particular piece of equipment.
Any injury, accident or medical incident occurring at the gym should be reported to UrbanX Fitness staff as soon as reasonably possible.
Nothing in these Terms & Conditions excludes or limits any liability that cannot lawfully be excluded or limited.
6. Group Classes
UrbanX Fitness may provide group exercise classes as part of selected memberships or for an additional charge.
Class timetables, instructors, class types and availability may change from time to time.
Where applicable, classes must be booked in advance. Members are expected to arrive on time and follow the instructions of the instructor.
UrbanX Fitness may impose reasonable booking, cancellation or late-arrival policies for group classes.
Members participating in group classes must inform the instructor of any relevant injury, medical condition or physical limitation that may affect their ability to participate safely.
UrbanX Fitness reserves the right to cancel, amend or relocate a class where reasonably necessary, including due to staff availability, maintenance, safety or operational requirements.
7. Junior Memberships
Junior memberships are available only to members who meet the age requirements determined by UrbanX Fitness.
All junior members must be accompanied and directly supervised while onsite by a membership holder who is aged 18 years or over.
The accompanying adult must remain responsible for the junior member throughout the junior member's time at UrbanX Fitness.
A junior member must not enter or use the gym without the required accompanying adult being present.
Junior members are strictly prohibited from using any weighted machines or other equipment designated by UrbanX Fitness as unsuitable for junior use.
Where required by UrbanX Fitness, junior members may only participate in designated activities, areas or classes approved for their age group.
UrbanX Fitness reserves the right to restrict access to particular equipment or areas where it considers this necessary for the safety of junior members.
8. Children & Juniors – Parent/Guardian Responsibility
Any child or junior who is brought onto or permitted to remain on the UrbanX Fitness premises is under the full responsibility and supervision of their parent or legal guardian, or the accompanying adult where expressly authorised by the parent or guardian.
The parent, legal guardian or responsible accompanying adult is responsible for:
The child's or junior's behaviour and conduct.
Their supervision at all times.
Ensuring they follow UrbanX Fitness rules and safety instructions.
Ensuring they do not use prohibited equipment.
Ensuring they do not interfere with other members, staff or gym operations.
Ensuring they remain within areas permitted by UrbanX Fitness.
Any information provided to UrbanX Fitness regarding the child's or junior's health, medical requirements or relevant circumstances must be up-to-date.
UrbanX Fitness does not provide childcare or child-minding services.
Children and juniors must never be left unattended unless UrbanX Fitness has expressly confirmed in writing that a particular supervised activity or class is being provided for them.
The parent or guardian acknowledges that they remain responsible for the child or junior while onsite, subject to UrbanX Fitness's own legal obligations and responsibilities under applicable law.
9. Equipment Use
Members must use all equipment in accordance with manufacturer instructions, gym signage and any guidance provided by UrbanX Fitness staff.
Members must not alter, misuse, dismantle, move or interfere with gym equipment unless authorised to do so.
Heavy weights must be handled responsibly and must not be dropped where doing so is likely to cause damage, excessive noise or risk of injury, except where equipment is specifically designed and designated for controlled dropping.
Any faulty, damaged or unsafe equipment must not be used and should be reported immediately.
10. Personal Belongings
Members are responsible for their own personal belongings while onsite.
UrbanX Fitness recommends that valuable items are not brought into the gym.
Where lockers are provided, members must use them appropriately and must not leave valuables unattended.
UrbanX Fitness is not responsible for loss, theft or damage to personal property except where liability arises that cannot legally be excluded.
11. Access, Security & CCTV
For security purposes, UrbanX Fitness may operate CCTV and other security systems within the premises, subject to applicable data protection and privacy requirements.
Members must not permit unauthorised persons to enter the premises.
Tailgating, allowing another person to enter using your access credentials, or deliberately bypassing access-control procedures is prohibited.
Any attempt to gain unauthorised access may result in suspension or termination of membership.
12. Emergency Procedures
Members must familiarise themselves with emergency exits, fire safety procedures and relevant emergency information displayed within the gym.
In an emergency, members must follow the instructions of UrbanX Fitness staff or emergency services and must evacuate the premises when instructed.
Emergency exits and safety equipment must never be obstructed, misused or tampered with.
13. Health & Safety
UrbanX Fitness takes reasonable steps to provide a safe environment and maintain its equipment and facilities appropriately.
Members are expected to take reasonable care of themselves and others and to follow all health and safety instructions.
Members must immediately report accidents, injuries, hazards, spillages, damaged equipment or other safety concerns to UrbanX Fitness.
14. Suspension or Termination
UrbanX Fitness may suspend or terminate a membership where a member:
Seriously breaches these Terms & Conditions.
Repeatedly fails to follow gym rules or reasonable staff instructions.
Engages in threatening, abusive, violent or unsafe behaviour.
Deliberately damages gym property.
Allows unauthorised persons to access the premises.
Uses another person's membership or access credentials.
Fails to make required payments, subject to the terms of their membership agreement and applicable law.
Where appropriate, UrbanX Fitness will provide notice of suspension or termination and any applicable rights available to the member.
Nothing in this section affects any statutory cancellation or consumer rights.
15. Changes to Facilities, Services & Timetables
UrbanX Fitness may make reasonable changes to equipment, facilities, opening arrangements, classes, instructors, timetables or services where necessary for operational, safety, maintenance or business reasons.
Where a change materially affects a member's contractual rights or services, UrbanX Fitness will act in accordance with the applicable membership agreement and consumer law.
16. Privacy & Personal Information
UrbanX Fitness will handle members' personal information in accordance with its Privacy Policy and applicable data protection legislation.
Members should ensure that all information provided to UrbanX Fitness is accurate and kept up to date.
17. Complaints
Any complaint should be raised with UrbanX Fitness as soon as reasonably possible so that the matter can be investigated and, where appropriate, resolved.

18. Acceptance of Terms
By joining UrbanX Fitness and continuing to use the facilities, the member confirms that they have had the opportunity to read these Terms & Conditions and agree to comply with them.
For junior members, the parent or legal guardian confirms that they accept responsibility for ensuring the junior member complies with the applicable junior membership conditions.
19. Applicable Law
These Terms & Conditions shall be governed by the laws applicable in the United Kingdom, and any disputes shall be dealt with by the appropriate courts having jurisdiction.
These Terms & Conditions should be read together with the member's individual membership agreement, pricing information, Privacy Policy, gym rules and any other applicable policies issued by UrbanX Fitness.
UrbanX Fitness reserves the right to enforce these Terms & Conditions fairly and consistently, subject to applicable law.
